RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, AND INDEMNITY AGREEMENTROAR HOCKEY ACADEMY BY SIGNING THIS DOCUMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT. PLEASE READ CAREFULLY! TO: ROAR Hockey Academy and each of their directors, officers, employees, instructors, agents, representatives, independent contractors, subcontractors, volunteers, sponsors, successors, and assigns (all of whom are hereinafter referred to as the "Releasees"). DEFINITION: In this Release Agreement, the term "Activities" means ice sports activities including, without limitation, skating, hockey, sledge hockey, ringette, figure skating, games, tournaments, corporate events, birthday parties, strength and conditioning training, skill development training, as well as any use of any facilities, training centres, arenas, or other buildings associated with ROAR Hockey Academy (collectively, the "Facilities"), transportation thereto or therefrom, and all other events, activities, programs, and services offered by, connected with, or related to any of the Releasees. ASSUMPTION OF RISKS: I understand that the use of a helmet designed for specific Activities may help reduce the risk of some types of injuries. I recognize that serious injury or death can result from both low and high-energy impacts, even when a helmet is worn. I am aware that participating in the Activities will expose me to many risks, dangers, and hazards including, without limitation, risk of injury, death, or property damage or loss due to: injury to the musculoskeletal and/or cardio-respiratory systems; improper use or failure of equipment; unwanted contact or collision with other people, equipment, or objects; physical contact, including but not limited to body contact or physical aggression, from other participants, whether within the rules of the game or not; loss of balance or control; tripping, slipping, or falling; medical conditions, whether known or unknown by me; failure to act safely or within one’s own ability; negligence on the part of myself, coaches, other participants, or other people around me; and NEGLIGENCE ON THE PART OF THE RELEASEES, INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS, AND HAZARDS OF PARTICIPATING IN THE ACTIVITIES. I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS, AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND LOSS RESULTING THEREFROM. RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT: In consideration of the Releasees agreeing to my participation in the Activities and permitting my use of their equipment, parking, and other facilities, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I hereby agree as follows: TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against THE RELEASEES, and TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense, or injury, including death, that I may suffer, or that my next of kin may suffer, as a result of my participation in the Activities, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any damage to property of or personal injury to any third party resulting from my participation in the Activities. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns, and representatives in the event of my death or incapacity. This Release Agreement and any rights, duties, and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of Alberta and no other jurisdiction. Any litigation involving the parties to this Release Agreement shall be brought solely within the Province of Alberta and shall be within the exclusive jurisdiction of the Courts of the Province of Alberta. In entering into this Release Agreement, I am not relying upon any oral or written representations or statements made by the Releasees with respect to my participation in the Activities other than what is set forth in this Agreement. THE PARTICIPANT OR HIS/HER LEGAL GUARDIAN HAS READ AND UNDERSTANDS THIS RELEASE AGREEMENT AND IS AWARE THAT, BY SIGNING THIS AGREEMENT, THE PARTICIPANT IS WAIVING CERTAIN LEGAL RIGHTS WHICH THE PARTICIPANT OR ANY OF THE PARTICIPANT’S HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS, AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.
